General conditions of sale

These general terms and conditions of sale (hereinafter the “ Terms and Conditions ") apply between the company JIMS, a simplified joint stock company, whose registered office is located at 74 rue Ducau, 33000 – Bordeaux, registered in the Bordeaux Trade and Companies Register under number 952 056 190 (hereinafter referred to as " STREET OF LILAC ») and any customer, natural person, of RUE DES LILAS.

1. Definition

  • Client(s): Means any consumer, within the meaning of the Consumer Code, placing an Order for Product(s) on the Website.
  • Order(s): Means any order for Products made by the Customer via the Website.
  • Customer Account: Refers to the account that can be created by the Customer by providing information concerning them before placing any Order on the Website.
  • CONTRACT : Refers to the General Terms and Conditions, the placing of the Order and the sale of the Products to the Customer.
  • Part(s): Refers to RUE DES LILAS and/or the Client.
  • Privacy Policy : Refers to the Privacy Policy
  • Product(s): Refers to the products offered for sale by RUE DES LILAS on the Website.
  • Website: Refers to the website available at the following address: rue-des-lilas.fr

2. General

The Products offered for sale by RUE DES LILAS on the Website are exclusively intended for Customers:

  • purchasing the Products for their personal use, excluding any resale or use for professional purposes.


Consequently, RUE DES LILAS reserves the right ( i ) to ask the Customer for any information enabling it to ensure their status as a consumer and ( ii ) not to follow up on Orders exceeding, by their content or frequency, the needs of a non-professional and more generally in the event of abnormal demand.

  • aged over 18 and having the capacity to contract.

Consequently, by placing an Order for Products on the Website, the Customer declares and guarantees ( i ) that he/she is at least 18 (eighteen) years old and ( ii ) that he/she is ordering the Products exclusively for his/her personal use. As such, he/she undertakes not to market, resell or distribute the Products in any way whatsoever to any person for purposes other than private and in particular commercial purposes.

These General Terms and Conditions may be modified by RUE DES LILAS at any time and without notice. Each Customer is therefore invited to regularly consult the latest updated version of the General Terms and Conditions, available to all and permanently accessible on the Website, and in particular, during each Order. The modified General Terms and Conditions will come into force as of their posting online and will therefore apply automatically.

Placing an Order after any modification to the T&Cs will constitute acceptance of these modifications by the Customer. If the Customer refuses to comply with any of the obligations and conditions contained in these T&Cs, he is invited not to place an Order.

French is the only language offered for the Contract.

3. Product characteristics

In accordance with Articles L. 111-1 and L. 221-5 of the Consumer Code, the Customer may, prior to placing an Order, find out on the Website the essential characteristics of each of the Products offered for sale.

The photographs, graphics and descriptions of the Products are given for information purposes only and do not in any way bind RUE DES LILAS.

4. Product prices

The price of the Products is indicated per unit on the Website in euros and all taxes included, it being specified that the Products ordered will be invoiced, where applicable, at the prices in effect when the Order is registered.

Shipping costs are the responsibility of the Customer and are added at the time of validation of the Order.

RUE DES LILAS reserves the right to modify the prices of the Products offered on the Website at any time.

5. Availability of products

The offers of Products proposed by RUE DES LILAS are valid as long as they are announced on the Website, within the limit of available stocks.

If a Product is displayed on the Website as out of stock, the Customer may contact RUE DES LILAS to obtain the supply times associated with said Product.

In the event of unavailability of one or more Products after placing the Order, the Customer will be notified as soon as possible by RUE DES LILAS, by email, without the Customer being able to claim any damages or compensation whatsoever from the latter. RUE DES LILAS will reimburse the price of the unavailable Product(s) ordered within a maximum period of 14 (fourteen) days from the aforementioned information email.

The Customer is informed that in consideration of the rare or speculative nature of certain Products, restrictions on quantities may be applied to Orders made by members of the same household, the household designating Customers with the same name and the same postal address and/or the same bank details. RUE DES LILAS reserves the right to refuse all or part of an Order by virtue of this restriction.

6. Customer Account

6.1 Creation of the Customer Account

The Customer will have the option to create a Customer Account by entering their email address. They will receive a single-use code in the same email each time they log in.

The Customer must ensure the validity of the information communicated and its accuracy.

The Customer who has a Customer Account can access certain functionalities relating to his Orders directly via his Customer Account (Order tracking, etc.).

6.2 Subscription to the newsletter

The Customer may authorize RUE DES LILAS to send him a newsletter to the email address he has provided on the Website or by checking the box authorizing the sending of the newsletter when creating his Customer Account.

The Customer can unsubscribe from the newsletter by clicking on the unsubscribe link inserted in the email containing the newsletter.

7. Order process

7.1 Placing the Order

Orders are placed exclusively on the Website's online store. To do this, the Customer selects the desired Products and their quantity, which then appear in their virtual shopping cart.

In order to continue with the Order, the Customer must then enter their billing and delivery details, their payment method and their bank details. In the event of automatic entry, the Customer is invited to check the accuracy of their details before confirming the Order. RUE DES LILAS cannot be held responsible for the non-receipt of the Products in the event of an error, particularly in the delivery address provided by the Customer.

A summary of the Order is submitted to the Customer before validation, specifying the Product(s) chosen, their unit price, the chosen payment option and the total price to be paid including all taxes as well as the possibility of downloading the General Terms and Conditions. The Customer undertakes to check that the summary corresponds to the Order he wishes to make before validating his Order. Otherwise, he can modify it in whole or in part by returning to the previous pages and a new summary will be submitted to him.

If the Customer has a code that may grant him an advantage or a promotion on the Products, it must be registered when placing the Order. This code can only be used once during its validity period. It is personal and non-transferable.

Once the Order and its amount have been verified, the Customer must declare that they have read and accepted the General Terms and Conditions by checking the corresponding box. Validation constitutes acceptance of the General Terms and Conditions, prices, volumes, characteristics, quantities and delivery times of the Products ordered.

7.2. Payment of the Order

Payment for the Order is made in euros by CB, Visa or Mastercard bank card via the secure platform of the payment service provider SHOPIFY PAYMENTS.

By validating his Order, the Customer expressly acknowledges having read and accepted the confidentiality policy and the general conditions of service of the payment service provider SHOPIFY PAYMENTS, accessible via the following URL address: https://www.shopify.com/fr/legal/terms-payments/fr .

The Customer agrees to provide accurate and up-to-date information. The Customer is informed that payment may be refused if the bank card used has expired, if the maximum spending amount has been reached or if the information entered is incorrect.

RUE DES LILAS may also refuse or cancel any Order when ( i ) the banking information provided by the Customer is incorrect or misused and/or ( ii ) in the event of refusal of payment authorization by accredited organizations (banks, SHOPIFY PAYMENTS) or ( iii ) if there is a dispute with the Customer concerning the payment of a previous Order.

RUE DES LILAS cannot under any circumstances be held responsible for any fraudulent use of the bank card used for payment of the Order by the Customer.

Once the Order has been paid, an email detailing the summary of the Order will be sent by RUE DES LILAS to the Customer, which will also be available on their possible Customer Account.

In accordance with Article L. 133-8 (I) of the Monetary and Financial Code, the Customer cannot revoke the payment order once it has been received by its payment service provider.

8. Delivery of products

8.1 Terms of delivery of the Products

Delivery of the Products is made in mainland France, Germany, the Netherlands, Belgium, Luxembourg, Portugal, Spain, Italy, Austria, Ireland and the United States.

Delivery may be made by Colissimo to the Customer's home or to a relay point depending on the Products ordered. The delivery offer available for the Product ordered as well as the associated costs will in any event be indicated on the Order placement page. Orders delivered to a relay point are delivered to the relay point chosen by the Customer on opening days and times. The Customer will be informed of the arrival of their package by email and/or text message.

The Products are generally delivered within 5 working days following confirmation of shipment by RUE DES LILAS, which is notified to the Customer via email. The Customer acknowledges, however, that delivery times may be extended depending on the geographical area corresponding to the address provided for delivery.

In any event, the Customer can track the status of his Order and the expected delivery date in the dedicated personal space of his Customer Account, via a link to the carrier's website. In the event of non-compliance with the agreed delivery date or deadline, the Customer must, before any termination of the Contract, order RUE DES LILAS to execute the delivery within a reasonable additional period. In the absence of execution within this new period, the Customer may terminate the Contract.

RUE DES LILAS reserves the right to close its company exceptionally. In such a case, RUE DES LILAS undertakes to inform the Customer ( i ) of the period of closure of the company and ( ii ) of its reopening date, in a clear and legible manner, on the interface of the Website and will postpone, if necessary, the shipments of Orders upon its reopening.

RUE DES LILAS reserves the right to suspend any delivery of Products in the event of late payment and/or failure to collect from the Customer's bank account.

In the event of a Product return due to an “ incomplete address ” or “ unknown recipient at the address ”, RUE DES LILAS will contact the Customer to request additional information on the delivery address. In the event of reshipment, the delivery costs will be borne by the Customer.

8.2 Transfer of risks and retention of title

RUE DES LILAS retains full ownership of the Products sold until full payment of the price, including principal, costs, taxes of various kinds and compulsory contributions.

In accordance with Articles L.216-4 of the Consumer Code, any risk of loss or damage to the Products is transferred to the Customer at the time when the latter or a third party designated by him, and other than the carrier proposed by RUE DES LILAS, takes physical possession of the Products. The taking of possession by the Customer is materialized by the signature of a delivery receipt.

9. Guarantees

The Customer is required to check the contents of the package received at the time of delivery. In the event of a reservation about the Product delivered (for example: damaged package, already opened, missing products or incorrect references), the Customer undertakes to notify RUE DES LILAS within 10 (ten) days of receipt of the Product, with supporting photos.

In the event that the Customer receives a damaged Product, he/she must immediately inform RUE DES LILAS, with supporting photo, which undertakes to reship the damaged Product to the Customer as soon as possible, within the limit of available stocks.

9.1 Guarantee of conformity

The Customer has a period of two years from the delivery of the Product to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the Customer is only required to establish the existence of the lack of conformity and not the date on which it appeared.

This warranty does not cover damage resulting from misuse of the Product, normal wear and tear due to its use or failure to follow washing and maintenance instructions.

The legal guarantee of conformity entails an obligation for RUE DES LILAS, where applicable, to provide all updates necessary to maintain the conformity of the Product.

The legal guarantee of conformity gives the Customer the right to repair or replacement of the Product within 30 (thirty) days following his request, free of charge and without major inconvenience for him.

If the goods are repaired under the legal guarantee of conformity, the Customer benefits from a 6 (six) month extension of the initial guarantee.

If the Customer requests the repair of the Product, but RUE DES LILAS imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the Product.

The Customer may obtain a reduction in the purchase price by keeping the Product or terminate the Contract by obtaining a full refund upon return of the goods, if:

  • RUE DES LILAS refuses to repair or replace the Product;
  • The repair or replacement of the Product occurs after a period of 30 (thirty) days;
  • The repair or replacement of the Product causes a major inconvenience for the Customer, in particular when the Customer definitively bears the costs of recovery or removal of the non-compliant Product, or if he bears the costs of installation of the repaired or replacement Product;
  • The non-conformity of the Product persists despite RUE DES LILAS's unsuccessful attempt to bring it into conformity.

The Customer is also entitled to a reduction in the price of the Product or to the termination of the Contract when the lack of conformity is so serious that it justifies the reduction in price or the termination of the Contract being immediate. The Customer is then not required to request the repair or replacement of the Product beforehand.

The Customer is not entitled to rescission of the sale if the lack of conformity is minor.

Any period of immobilization of the Product for the purpose of its repair or replacement suspends the warranty which remained to run until delivery of the repaired Product.

The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the consumer code.

If RUE DES LILAS hinders the implementation of the legal guarantee of conformity in bad faith, it is liable to a civil fine of a maximum amount of 300,000 euros, which may be increased to 10% of the average annual turnover ( article L. 241-5 of the consumer code ).

9.2. Legal guarantee of hidden defects

The Customer also benefits from the legal guarantee of hidden defects in application of the Articles 1641 to 1649 of the Civil Code , for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the Product is kept or to a full refund upon return of the Product.

9.3 Return of Products

To benefit from the guarantees described in articles 9.1 and 9.2 of the General Terms and Conditions, the Customer must keep and present the purchase invoice for the Product.

For any Product that the Customer wishes to return under the guarantees provided for in Articles 9.1 and 9.2, the Customer must contact RUE DES LILAS or go to their Customer Account to notify their wish to return the Product.

The Customer will then return the Product, in the condition in which it was delivered, to the following address: 8 rue Sainte Isaure, 75018 - Paris.

If the returned Product does not benefit from one of the guarantees provided for in articles 9.1 and 9.2, the Customer will return the Product at its own expense.

10. Right of withdrawal

10.1 Principle

In accordance with the provisions of Article L.221-18 of the Consumer Code, the Customer has a period of 14 (fourteen) clear days from the date of receipt of the Products to inform RUE DES LILAS of his wish to withdraw.

The Customer will exercise this right ( i ) by completing and submitting the withdrawal form available in Appendix 1 of the General Terms and Conditions (at the bottom of the page), or ( ii ) by sending an unambiguous declaration expressing his/her wish to withdraw and identifying the Customer. The aforementioned form or declaration must be sent by email to RUE DES LILAS at the following email address: hello@rue-des-lilas.fr .

When this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

In accordance with Article L.221-23 of the Consumer Code, the Customer will then have a period of 14 (fourteen) days following the communication of his decision to withdraw to return, at his expense, in his original condition (i.e. intact and unstained), the Products ordered, against reimbursement.

If the intact Product is not returned by the Customer within 14 (fourteen) days following the communication of his decision or if the Product does not correspond to the characteristics of the intact Product, the return is not valid and the Customer must keep the Product, it being specified that where applicable, the return costs will be borne by the Customer.

In accordance with Article L.221-28 of the Consumer Code, the Customer is informed that the right of withdrawal cannot be exercised for contracts:

  • For the supply of goods which have been unsealed after delivery and which cannot be returned for reasons of hygiene or health protection.

Return costs are free in the event of a refund request.


10.2 Reimbursement terms

In accordance with Article L.221-24 of the French Commercial Code, RUE DES LILAS will reimburse the Customer for all sums paid, including delivery costs, without undue delay and at the latest within 14 (fourteen) days from the date on which it is informed of the Customer's decision to withdraw, the reimbursement may be deferred until recovery of the Products.

Reimbursement to the Customer will be made by automatic transfer to the Customer's bank account used by the latter to place the Order, or via any other means agreed between the Customer and RUE DES LILAS.

11. Exchanges

In addition to his right of withdrawal, the Customer has a period of 14 (fourteen) clear days from the date of receipt of the Products to inform RUE DES LILAS of his wish to exchange the Product received.

The Customer will exercise this right by sending a declaration, free of ambiguity, expressing his/her desire to exchange his/her Product and allowing the identification of the Customer, the Order number and the new Product requested. The aforementioned declaration must be sent by email to RUE DES LILAS at the following email address: hello@rue-des-lilas.fr .

In the event that the new selected Product is offered at a lower price than the initial Product, the Customer will receive a credit in an amount corresponding to the price difference of the two Products. This credit will be valid for one (1) year from its date of issue and can be used on the Website.

In the event that the new selected Product is offered at a higher price than the initial Product, the Customer will have to pay the price difference in accordance with the T&Cs.

Return costs are free in Metropolitan France (including Monaco and Corsica), with the exception of returns from abroad. The delivery costs of the new Product requested will be borne by the Customer and invoiced according to the delivery method chosen. The new Order will be subject to the General Terms and Conditions in force at the time of the exchange.

12. Deletion of customer account

12.1 Deletion of the Customer Account by RUE DES LILAS

Failure by the Customer to comply with the obligations entered into under the Contract, any incident of payment of the price of an Order, the provision of false information when creating the Customer Account, may result in the suspension of access to the Customer Account or even the deactivation of the Customer Account depending on the seriousness of the actions in question, without any damages or compensation whatsoever being claimed from RUE DES LILAS.

RUE DES LILAS reserves the right to refuse any Order from a Customer with whom such a dispute exists, even if the latter does not use a Customer Account.

12.2 Deletion of the Customer Account by the Customer

The Customer may request the deletion of his Customer Account by contacting RUE DES LILAS and providing proof of his identity via the customer service contact form or the following email address: hello@rue-des-lilas.fr .

13. Customer service and complaints

If after written request and exchange with the RUE DES LILAS customer service, the Customer's claim is refused, the latter may choose to benefit from a completely free mediation service. The Customer may use it for any disputes that may arise regarding the validity, interpretation, execution, non-execution or interruption of the purchase of a Product in the event that no solution has been found.

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, RUE DES LILAS adheres to the Consumer Mediation Center of Conciliators of Justice of a consumer mediation service, located at 49 rue de Ponthieu, 75008 - Paris (hereinafter the " Mediator "). After prior written action by consumers towards RUE DES LILAS, the Mediator's service may be contacted for any consumer dispute that has not been resolved. To find out how to contact the Mediator, the Customer can consult the Mediator's website, accessible at the following address: https://www.cm2c.net/ , or contact him by email at cm2c@cm2c.net , or by phone at 01 89 47 00 14.

However, both the Client and RUE DES LILAS remain free to accept or refuse this amicable recourse to mediation.

Furthermore, for all practical purposes, in accordance with Article 14 of Regulation (EU) No 524/2013, the European Commission has set up an online dispute resolution platform, facilitating the independent out-of-court resolution of online disputes between consumers and professionals in the European Union. This platform is accessible via the following link: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=FR .

14. Intellectual Property

It is recalled that all intellectual property rights, including copyright (photographs, images, graphic charter, video, texts, graphics, etc.), distinctive signs such as brands and logos, designs and models, etc. relating to the Products and/or the Website and/or RUE DES LILAS, are and remain the property of RUE DES LILAS or that of the holders of the intellectual property rights concerned. Recognizing these exclusive rights over these signs, the Customer undertakes not to use them for any purpose other than that related to the use of the Products and to infringe the intellectual property rights of RUE DES LILAS or those of the holders of the rights concerned.

Any use of intellectual property rights of any nature whatsoever and any use of these distinctive signs, other than that linked to the use of the Products, is prohibited without the express, written and prior consent of the holders of the rights concerned.

15. Personal data

The use of the Website and the placing of an Order under the conditions described in the General Terms and Conditions result in the processing by RUE DES LILAS and, where applicable, its partners, of the Customer's personal data.

16. Liability

16.1 Responsibility of RUE DES LILAS

RUE DES LILAS shall not be held liable in the event that the non-performance or poor performance of its obligations (and in particular in the event of late delivery) is attributable either to the behavior of the Customer, or to the unforeseeable and insurmountable act of a third party (such as, in particular but not exclusively, an inability to supply suffered by RUE DES LILAS despite all reasonable efforts to remedy this situation) or to a case of force majeure as defined by the legislation in force and interpreted by the French Courts (such as, in particular but not exclusively, strikes, natural disaster, flood, fire, etc.).

In the event of an error in entering the email address provided by the Customer, or non-receipt of the Order confirmation email, RUE DES LILAS shall not be held liable. In this case, the sale will be considered final, except in cases of cancellation of the Order by RUE DES LILAS, in particular due to unavailability of the Products. The Customer may nevertheless exercise his right of withdrawal under the conditions set out in Article 10 of the General Terms and Conditions.

The Customer is also informed that the Website may be exceptionally unavailable for a variable period of time due, in particular, to preventive, predictive or evolutionary maintenance. No compensation, of any nature whatsoever, may be claimed from RUE DES LILAS in the event of damage, and in particular the impossibility of continuing the Order, resulting from the unavailability of the Website.

16.2 Customer Liability

RUE DES LILAS works to protect the personal information of Customers by ensuring a high level of security, but the Customer also has a role to play in protecting his personal data. In particular, the Customer must maintain the security of his online transactions, for example by not communicating his identifier (Customer's email address) and/or password to third parties and by regularly changing his password. As such, RUE DES LILAS cannot be held responsible for the disclosure of information concerning the Customer to any individual who has used his identifier (Customer's email address) and/or password.

17. Miscellaneous provisions

The Contract between the Client and RUE DES LILAS and/or its successors and assigns is binding between the Parties. The Contract, the rights and obligations of the Parties may not be assigned or transferred without the prior written consent of the other Party.

The fact that a Party does not avail itself of a stipulation of the T&Cs does not in any way constitute a waiver of the benefit of said clause.

The Parties undertake, in general and for the entire duration of the Contract, to always behave towards each other as loyal and good faith partners, and in particular to immediately report any difficulty they may encounter in the performance of the Contract.

The nullity, unenforceability or, more generally, the lack of effect of any of the provisions of the Contract shall not affect the remainder of the Contract and the latter shall be executed as if this provision had never existed, provided, however, that this does not compromise the balance of the Contract and that the provision in question was not a determining condition of the consent of a Party. Furthermore, the Parties agree to replace, as far as possible, any provision deprived of effect by a valid provision having the same effect and reflecting, as far as possible, their initial intention.

18. Applicable law and competent courts

The T&Cs are subject to French law and French standards in force, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
