This Privacy Policy is an integral part of the general terms and conditions of sale (" GTC" ) of JIMS, a simplified joint stock company, whose registered office is at 74 rue Ducau, 33000, Bordeaux, registered in the Bordeaux Trade and Companies Register under number 952 056 190 (hereinafter referred to as " STREET OF LILAC »), accessible at the address www.rue-des-lilas.fr . As such, terms with a capital letter have the same definition as that given to them in the T&Cs.
1. Definition
- Cookie(s) means a "tracker" or small computer file placed and read when consulting a website, an application or even the use of software, regardless of the type of terminal used, such as a computer or a smartphone, tablet, etc., which helps to provide services to the User. Cookies are used in particular to collect information useful for the User's connection or to carry out audience measurement statistics.

Unless otherwise specified, the Data Controller is the owner of the Website. In this case, the Data Controller (or Owner) means RUE DES LILAS.

The use for any purpose of the Website and/or any placing of an Order may result in the collection and Processing of Personal Data, carried out in compliance with the regulations in force and in particular Law No. 78-17 of 6 January 1978, as amended, relating to information technology, files and freedoms and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter the " GDPR ").

- when it is in the legitimate interest of RUE DES LILAS, or;

4. Rights of data subjects
4.1. Information
In accordance with the GDPR, the Person Concerned by the processing of their Data has the right to exercise the following rights with RUE DES LILAS:
- the right to access, rectify and/or delete their Data;
- the right to object to the processing of his/her Data, to request the limitation of the processing of the Data;
- the right to request the portability of their Data;
- the right to withdraw or modify his/her consent to the collection and processing of his/her Data;
RUE DES LILAS undertakes to notify any Data breach likely to generate a high risk for the rights and freedoms of the Data Subjects and to the competent supervisory authority (CNIL in France).

In the event of no response within one month following the request (the period may be extended to three months for a complex request) or in the event of an unsatisfactory response, the Person Concerned by the Processing of their Data has the option of contacting the CNIL ( www.cnil.fr ).
5. Duration of storage of personal data
In accordance with the provisions of the regulations in force, the Data processed are kept for limited periods necessary to fulfill the purposes for which they were collected, and, in general, for the entire period necessary to:
- management of Order processing (placing an Order, delivery, after-sales service);
- to the operation of the Customer Account on the Website;
- the communication of information and/or commercial offers from RUE DES LILAS, if the Client has given his express and prior consent;
- the fulfillment of legal retention obligations incumbent on RUE DES LILAS;
- the production of statistics which will be used by RUE DES LILAS, in particular for the improvement of its Website.
In any event, the retention period of Personal Data will not exceed 3 (three) years in active database followed by 2 (two) years in intermediate archiving in a pseudonymized and/or anonymized form, except for exceptions linked to the legal, accounting and tax obligations incumbent on RUE DES LILAS.
Indeed, in order to resolve conflicts, prevent fraud, abuse, apply the General Terms and Conditions and/or comply with legal obligations, RUE DES LILAS reserves the right, in compliance with legal and regulatory requirements, to retain some of the Data processed for a limited period, even if they are no longer necessary for the provision of the Products or for accessibility to the Customer Account (for example, the Billing Data is retained for 10 (ten) years in intermediate archiving in application of article L123-22 of the French Commercial Code).
6. Recipients of data
The Personal Data that the User provides on the Website and/or when placing an Order may be intended for:
- to RUE DES LILAS and more particularly to personnel authorized by reason of their mission (sales department, customer service, legal department, etc.);
- to RUE DES LILAS subcontractors and service providers authorized for the execution of the Order (transport of products, payments, etc.), it being specified that the contract signed between these subcontractors/service providers and RUE DES LILAS mentions the Data protection obligations entrusted to them.
The Data may also be made available to the competent public authorities when required by law or upon requisition.
The User may request the updated list of RUE DES LILAS subcontractors and service providers at any time from RUE DES LILAS.
7. Transmission of personal data to third parties
The Data may be transmitted to external service providers or partners of RUE DES LILAS, who process this Data either ( i ) as Data Controller (in particular banks) or ( ii ) as subcontractors (in particular hosts, payment providers, carriers, communications agencies, etc.).
The Data may be transferred and processed outside the European Union, in particular in the event of exploitation of the Data on social networks.
In this case, and prior to any transfer, RUE DES LILAS ensures the security of the transfer of this Data. In the event that the legislation of the country concerned by the transfer of the Data has not been recognized as providing an adequate level of protection of the Data, RUE DES LILAS undertakes to ensure that the necessary measures are put in place in accordance with the GDPR (cross-border flow agreements in accordance with the standard contractual clauses issued by the European Commission).
8. Method and security of processing personal data
RUE DES LILAS processes the Data of the Data Subjects in an appropriate manner and takes all necessary security measures to prevent unauthorized access, disclosure, modification or unauthorized destruction of the Data. Thus, the processing of the Data is carried out using computers or IT tools and following procedures and organizational modes strictly related to the purposes of the indicated processing.
The User is informed that the Data relating to his bank details are processed securely on behalf of RUE DES LILAS by its payment service provider SHOPIFY PAYMENTS, certified according to the PCI-DSS standard, a recognized international security standard.
9. Data collected by Shopify
RUE DES LILAS uses the services provided by the company Shopify Inc. (hereinafter " SHOPIFY ") to host the Website. When using the Website, and in particular when placing an Order, certain Data may be collected and used by SHOPIFY. However, it is specified that this Data is collected and Processed by SHOPIFY on behalf of RUE DES LILAS.

10. General information
10.1 Legal action
The User's Personal Data may be used for legal purposes by the Data Controller, in Court or at any stage leading to possible legal action arising from improper use of the Website or related services.
The User is aware that public authorities may require the Data Controller to disclose Personal Data.
10.2 System Log and Maintenance
For operation and maintenance purposes, the Website and any third-party services may collect files that record interaction with said Website (System logs) or use for this purpose any Personal Data (such as the IP Address).

10.5 Modification of the privacy policy
RUE DES LILAS reserves the right to modify the Privacy Policy at any time. If a User objects to any modification made to this Privacy Policy, the User must stop using the Website or placing any Order and may request the Data Controller to delete his/her Personal Data.
Unless otherwise stated, the then Privacy Policy applies to all Personal Data that the Data Controller holds about Users.
11. Cookies
RUE DES LILAS uses Cookies to enable optimal navigation and provide the User with services adapted to their requests (e.g.: saving the shopping cart, saving login data, etc.). RUE DES LILAS also uses Cookies to measure the audience of its Website, improve its performance and offer the User targeted content according to their preferences.
